Terms of Service

These Terms of Service ("Terms") govern your use of the FlexDash mobile application and website (collectively, the "Service") operated by TechBuildDreams LLC ("we", "us", or "our").

1. Acceptance of Terms

By creating an account or using FlexDash, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

FlexDash is a gig driver companion app that provides mileage tracking, expense management, earnings scanning, toll detection, community gas prices, delay reporting, and tax report generation. The Service is designed for independent contractors and gig economy workers.

3. Account Registration

• You must provide accurate information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old to use the Service
• One account per person — do not share your account

4. Subscription & Billing

• FlexDash offers a subscription plan at $4.99/month (or current listed price)
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
• Payment is charged through Apple App Store or Google Play Store
• You can manage or cancel your subscription in your device's subscription settings
• Refunds are handled by Apple or Google per their respective refund policies
• We may change pricing with 30 days notice — existing subscribers keep their rate until renewal

5. Free Trial

• New users may receive a free trial period (currently 30 days for early members)
• You will not be charged during the free trial
• If you do not cancel before the trial ends, your subscription will begin and you will be charged

6. User Data & Content

• You own all data you enter into FlexDash (earnings, expenses, mileage, photos)
• You grant us a limited license to process your data to provide the Service
• You can export or delete your data at any time
• We are not responsible for data accuracy — you should verify all tax-related data with a professional

7. AI-Powered Features

• Screenshots are processed by Google Gemini AI for data extraction
• AI results may contain errors — always review extracted data before relying on it
• Screenshots sent for processing are not stored permanently by us or Google

8. Location Services

• Mileage tracking requires location permission (GPS)
• Auto-detect driving requires "Always" location permission for background tracking
• You can disable location features at any time in Settings
• We do not track your location for advertising or sell location data

9. Community Features

• Gas price contributions are anonymous and aggregated by zip code
• Toll plaza reports are shared with other users to improve accuracy
• Do not submit false, misleading, or harmful community data

10. Defense Reports & Delay Logs

• FlexDash provides tools to document delays and generate defense reports
• We do NOT guarantee that defense reports will prevent deactivation from any platform
• Reports are based on data you provide — accuracy is your responsibility
• FlexDash is not a legal service and does not provide legal advice

11. Prohibited Uses

• Do not use FlexDash to fabricate false delay reports or fraudulent data
• Do not attempt to reverse-engineer, hack, or exploit the Service
• Do not use the Service for any illegal purpose
• Do not create multiple accounts to abuse free trials

12. Limitation of Liability

FlexDash is provided "as is" without warranties. We are not liable for:

• Inaccurate mileage tracking, tax calculations, or AI extraction results
• Account deactivation from any gig platform (Amazon, DoorDash, etc.)
• Data loss due to device failure, app crashes, or service outages
• Any indirect, incidental, or consequential damages

Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

13. Termination

• You can delete your account and data at any time from Settings
• We may suspend or terminate accounts that violate these Terms
• Upon termination, your data will be deleted within 30 days

14. Governing Law

These Terms are governed by the laws of the State of New York, United States. Any disputes will be resolved in the courts of Albany County, New York.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or in-app notification. Continued use after changes constitutes acceptance.
